Outcome:
Acquittal - Not Guilty. CHP sees client running across multiple lanes of freeway traffic at night headed towards a crashed car. Client is detained, handcuffed, and placed in the back seat of a patrol car. Client submits to Field Sobriety Tests and returns a BAC test result of .17. He is arrested and charged with DUI. Represented by Mr. Flores, the out-of-custody Client pleads Not Guilty at arraignment and invokes his right to a speedy trial.
Two CHP officers testify at trial that Client admitted being the driver of the crashed car. On cross-examination, by Mr. Flores the officers admit that client first told him that he was not the driver and that he was on the scene looking for his cousin who had crashed. Client does not testify at trial.
In a pretrial motion, Mr. Flores persuades the court to exclude a recorded statement given by Client to CHP because the officer failed to inform client of his Miranda rights before interrogating him. The prosecutor is allowed to introduce evidence of Client's alleged admission of driving, but not the audio recording.
Jury returns a verdict of Not Guilty on all counts!
