Not Guilty on Count 1, Count 2 dismissed. 18 year old client is arrested in San Francisco's Union Square for robbery and battery of two street merchants. It is alleged that she and a group of young girls were harassing and stealing from merchants when the situation escalated and the girls, including client, started beating a female and a male merchant.
Client pled Not Guilty and demanded a jury trial. An offer by the DA to have the client participate in community service in exchange for a full dismissal was rejected.
Client and another witness testified at trial that client did not touch victim 1 (female) and that she punched victim 2 (male) twice but only after he grabbed and hit her underage female friend.
On cross-examination by Mr. Flores Victim 1 basically admitted that she could not describe who hit her. Cross-examination of the Robbery Detective revealed that he lied to Client repeatedly to get her to admit a crime and that he disregarded her claim of defense of others.
The jury returned a Not Guilty verdict as to Victim 1, and a hung jury as to Victim 2. The District Attorney's Office ultimately decided against retrying Client for battery against Victim 2 and dismissed the remaining count.
