Dismissal of resisting arrest charge - SJPD. 19 year old client was leaving a party in downtown San Jose. Client was ordered by San Jose Police officer to hurry up and leave the area. Client tried to explain to the officer that she just wanted to wait for her ride to exit the party so that she could leave. Officer responded with profanity which led to an unpleasant interaction resulting in client getting the short end of the stick and being arrested and charged with obstructing justice. Ultimately, the case was dismissed completely following client’s participation in an informal diversion program which involved light volunteer work at a nonprofit of her choosing.
