Dismissed at Trial. 15 year old client is arrested and charged with a gang related armed robbery, felony assault, and felony possession of stolen property. Five other juveniles are charged with being involved in the same crime based on identification by the victim. Client's plea of innocence to the DA fall on deaf ears and, despite no criminal history, client is treated as a violent gang member. Ultimately, the DA takes the position that he'll dismiss the charges against 1 out of the 6 minors if the other 5 plead guilty to either a felony armed robbery or felony assault with a deadly weapon. We strongly reject the offer and insist on a trial. Client maintains his innocence and the case is dismissed at trial after the victim admitted that he did not recognize client, and others, as being involved in the robbery.
